Terms & Conditions

Welcome to Defiant Sense. These Terms & Conditions govern your relationship with Defiant Sense, including online enquiries, visits to our Amsterdam showroom, and purchasing premium retro-pop furniture. By browsing our website or placing custom orders, you agree to comply with these terms.

1. General Scope and definitions

Defiant Sense is a premium Dutch design brand specializing in 1970s retro-pop and space-age furniture. We operate under Dutch commercial legislation.

2. Custom Enquiries and Studio Orders

Because our products are crafted from molded polyurethane polymers and custom double-layered chrome tubing, each order is tailored. Any submission via our online forms represents an enquiry, not a binding sales contract. A binding sale is established only when you receive an official Order Confirmation document and invoice from our Amsterdam studio.

3. Prices and Tax (VAT)

All listed prices on our website are shown in Euros (€). For clients within the European Union, prices are inclusive of Dutch Value Added Tax (BTW) at the standard rate of 21% unless stated otherwise. Delivery charges are calculated individually based on location within Benelux or wider Europe.

4. Delivery, Inspection, and Risk

We offer premium white glove delivery services within the Netherlands, Belgium, and Luxembourg. Upon delivery, the buyer is required to inspect the furniture for transport damage or manufacturing defects. Any issues must be noted on the delivery receipt and reported to our studio within 48 hours of receipt.

5. Warranties

Defiant Sense provides a comprehensive 5-year structural warranty on chrome frames and steel structures, and a 2-year warranty on molded plastic polyurethane structures and upholstery under normal domestic conditions. Damage resulting from improper cleaning (use of corrosive chemicals on glossy plastics or chrome) is excluded from warranty coverage.

6. Intellectual Property

All rights, titles, and interests in the design, layouts, molded plastic structures, photography, text, and catalog illustrations belong exclusively to Defiant Sense. Reproduction or exploitation of these designs without prior written permission is strictly prohibited.

7. Right of Withdrawal (Consumentenrecht)

Under Dutch and EU consumer law, you are entitled to a 14-day cooling-off period for standard online purchases. Note that this right of withdrawal does not apply to custom-ordered upholstery combinations or bespoke molds specifically configured for the client.

8. Limitation of Liability

Defiant Sense shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products.

9. Governing Law and Court of Jurisdiction

These Terms & Conditions and all contract agreements with Defiant Sense are governed by the laws of the Netherlands. The parties agree that any disputes arising out of or in connection with these terms shall be submitted exclusively to the jurisdiction of the Court of Amsterdam (Rechtbank Amsterdam), Netherlands.
